Fluxie ("we", "us", or "our") is operated by Fluxie App, an Australian business. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in Schedule 1 of that Act. This policy explains what personal information we collect, how we handle it, and your rights under Australian law.
What We Collect
At this stage, we collect only your email address when you join our waitlist. We do not collect health data, payment information, or sensitive information (as defined under the Privacy Act 1988) through this website.
How We Use Your Information
In accordance with APP 6, we use your email address solely for the primary purpose for which it was collected:

We will not use or disclose your personal information for a secondary purpose without your consent, except as required or permitted by law.
Marketing Communications
All marketing emails we send comply with the Spam Act 2003 (Cth). Every email includes a functioning unsubscribe mechanism. We will honour all unsubscribe requests promptly and within 5 business days.
Disclosure to Third Parties
We use Kit (ConvertKit) to manage our email list. Your email address is stored and processed by Kit as our contracted service provider under APP 11. We take reasonable steps to ensure Kit handles your information in a manner consistent with the APPs. We will never sell, rent, or share your personal information with third parties for their own marketing purposes.
Storage and Security
Under APP 11, we take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. Your email is stored on servers maintained by Kit using industry-standard SSL/TLS encryption.
Access and Correction
Under APPs 12 and 13, you have the right to request access to the personal information we hold about you, and to request correction of information that is inaccurate, out of date, incomplete, or misleading. To make a request, email us at hello@fluxieapp.com. We will respond within 30 days. We will not charge a fee for access requests.
Complaints
If you believe we have breached the APPs or this Privacy Policy, you may make a complaint to us at hello@fluxieapp.com. We will respond within 30 days. If you are unsatisfied with our response, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.

Fluxie is not a medical device and does not provide medical advice. All content on this website is provided for general informational and educational purposes only. 3. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth). Data & Safety

We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Here is exactly how we manage your data at this stage of Fluxie's development.
What Data We Hold
At present, the only personal information we collect is your email address, submitted when you join our waitlist. We do not collect sensitive information (including health information as defined under the Privacy Act 1988), symptom logs, location data, financial information, or government identifiers through this website.
Where It Is Stored
Your email is stored securely by Kit (ConvertKit), our contracted email service provider. Kit employs industry-standard TLS/SSL encryption for data in transit and at rest, and maintains security standards consistent with APP 11 obligations.
Data Breach Notification
We comply with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988. In the event of an eligible data breach that is likely to result in serious harm to you, we will notify both you and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
Who Can Access It
Only Fluxie App' founding team can access your email address for the sole purpose of sending waitlist communications. We do not disclose your information to any third party for marketing, advertising, or analytics purposes.
How Long We Keep It
Under APP 11.2, we will take reasonable steps to destroy or de-identify personal information that we no longer need for any purpose permitted under the APPs. We will retain your email while you remain subscribed to our communications. You may request deletion at any time.
Your Rights Under the APPs

Correction (APP 13): Request correction of inaccurate, incomplete, or out-of-date information
Complaint: Lodge a complaint with us or with the OAIC if you believe your privacy rights have been breached

Future App — Health Data
When the Fluxie app launches, health information (as defined under the Privacy Act 1988, being a type of sensitive information) will be handled with the heightened protections required under APP 3 and APP 6. Health data will require explicit consent before collection, will be encrypted end-to-end, and will never be sold or disclosed to third parties for commercial purposes. A full updated Privacy Policy will be provided at that time.
