Quick summary

These Terms & Conditions ("Terms") form a binding agreement between you and Fluxie (ABN 41 488 231 365) ("Fluxie", "we", "us" or "our") when you use the Fluxie mobile application, the website at fluxieapp.com, and any related services (together, the "Service").

Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by them. If you don't agree, please don't use the Service.

These Terms should be read alongside our Privacy Policy, which explains how we handle your personal information.


1. About the Service

Fluxie is a cycle-tracking and health-logging application designed to help people understand their bodies by tracking their menstrual cycle, symptoms, moods, energy, food, and other personal health factors. It generates patterns and insights from the information you enter.


2. Eligibility

You must be at least 16 years old to use Fluxie. By using the Service, you represent that you meet this requirement. If you are under 16, please do not use Fluxie.

You need an account to use most features of Fluxie. When you register, you agree to:

You are responsible for all activity that occurs under your account. We reserve the right to suspend or close accounts that breach these Terms.


4. Health disclaimer — not medical advice

Fluxie is a personal wellness and self-tracking tool. The information, insights, patterns, cycle-phase estimates, hydration estimates, and any other content generated by or available through the Service are provided for informational and personal tracking purposes only.

The Service does not provide medical advice, diagnosis or treatment. Nothing in the Service is a substitute for professional medical advice, diagnosis, or treatment from a qualified health-care provider. Always seek the advice of your doctor or other qualified health professional with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read in Fluxie.

If you are experiencing a medical emergency, call your local emergency services immediately.

Doctor reports or data exports generated by Fluxie are summaries of information you entered. They are not clinical records, and Fluxie makes no representation that they are accurate, complete, or appropriate for any clinical purpose. How you use or share an export is your responsibility.


5. Subscriptions and payment

5.1 Plans

Fluxie is offered on a paid subscription basis. Current pricing is shown on our website and in the app. Prices are in Australian Dollars (AUD) and include GST where applicable.

5.2 Free trial

We may offer a free trial period (currently 7 days). You will not be charged during the trial. At the end of your trial, your subscription begins automatically unless you cancel before the trial period ends.

5.3 Billing and renewal

Subscriptions are billed in advance, either monthly or annually, depending on your chosen plan. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

5.4 Payment

Payments are processed through our third-party payment provider (Stripe). By subscribing, you authorise Stripe to charge your selected payment method in accordance with your plan. We do not store your full payment card details.

5.5 Cancellation

You may cancel your subscription at any time by visiting fluxieapp.com/subscribe or by contacting us at hello@fluxieapp.com. Cancellation takes effect at the end of your current billing period — you keep access until then. We do not offer partial-period refunds, except where required by law (see Section 5.6).

5.6 Refunds and Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). If the Service has a major failure, you may be entitled to a refund. Contact hello@fluxieapp.com to discuss your situation.

5.7 Price changes

We may change subscription pricing from time to time. We will give you reasonable notice before any price change affects your current subscription, and you will have the option to cancel if you don't agree with the new price.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

You own all the personal health data and content you enter into Fluxie. By using the Service, you grant us a limited, non-exclusive licence to store, process and use your data solely to provide the Service to you, as described in our Privacy Policy.

You are responsible for the accuracy of information you enter. We rely on what you tell us — we can't verify whether the information you enter is correct.

You can export or delete your data at any time. When you delete your account, we delete your data from active systems and backups within 30 days, except where we are required by law to retain it.


8. Intellectual property

The Fluxie name, logo, app design, branding, graphics, and all other content we create are owned by or licensed to Fluxie and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

These Terms do not give you any rights in our intellectual property other than a limited licence to use the Service for your own personal, non-commercial purposes.


9. Third-party services

The Service integrates with or links to third-party services such as Supabase (database and auth), Stripe (payments), Apple and Google (app distribution and sign-in). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

The Service may include links to external websites. We don't endorse and are not responsible for the content of linked sites.


10. Disclaimers and limitation of liability

To the maximum extent permitted by law (and subject to your rights under Australian Consumer Law):

Nothing in these Terms excludes, restricts or modifies any consumer right or remedy under Australian Consumer Law that cannot lawfully be excluded.


11. Indemnification

You agree to indemnify and hold harmless Fluxie and its personnel from any claims, damages, losses, costs or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Service in a way that violates any law or infringes any third party's rights.


12. Changes to the Service

We may update, modify, suspend or discontinue any part of the Service at any time. Where changes are material, we will take reasonable steps to give you advance notice. If you are a paying subscriber and we discontinue the Service, we will provide a pro-rata refund for any unused subscription period.


13. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date. Where changes are material, we'll take reasonable steps to notify you (for example, via an in-app notice). Continuing to use the Service after the effective date of updated Terms constitutes acceptance of those Terms.


14. Termination

You may stop using the Service and delete your account at any time from the Settings screen or by contacting us.

We may suspend or terminate your access if you breach these Terms, if we discontinue the Service, or if required by law. Where possible, we will give you reasonable notice. On termination, your right to use the Service ends, but Sections 7–11 and 14–16 continue to apply.


15. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms.
